PDP GAMING INSTAGRAM IMAGE SCRAMBLE CONTEST

Eligibility: Open to legal residents of the USA who are 18 or older with an active Instagram account. Employees and directors of PDP and its subsidiaries, affiliates, and advertising agencies are not eligible, nor are persons involved in the execution or administration of this Contest, or the immediate family members of each above (including individuals residing in the same household).
Entry Period: The PDP Gaming Instagram Image Scramble Contest (“Contest”) begins at 8:00 AM Pacific Time (PT) on June 12, 2020 and ends at 4:00 PM PT on June 12, 2020 (the “Entry Period”). By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Performance Designed Products LLC (“PDP” or “Sponsor”), which shall be final and binding in all respects.
How to Enter: To enter the Contest log in to your registered Instagram account during the Entry Period and visit https://www.instagram.com/pdpgaming/ to find the Contest post. Then, reply with a guess as to what the close-up image is in the promotional post. You must set your Instagram account settings to “unprotected” or “public” to be eligible. The entry limit is one guess per person. Automated or robotic entries will be disqualified. More than one entry will void that entrant’s entry and that entrant will be disqualified.
This contest is not sponsored, endorsed, administered by, or associated with Instagram.
Winner Selection: The winner of the Contest will be selected based on who was able to correctly guess the product, in the promotional post, first. The determination of the winner will be made within 48 hours of the conclusion of the Entry Period by Sponsor or its designated representatives, whose decisions are final. Winner will be notified through their Instagram account on or about 48 hours after the determination. Potential winner must accept a prize as directed by Sponsor within 48 hours of notification. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. By accepting a prize, you agree that PDP may use your entry, name, image and hometown online and in print, or in any other media, in connection with this Contest without payment or compensation to you, except where prohibited by law.
Prize: The winner will receive the correctly identified PDP product. Approximate Retail Value (ARV) is $35.00. Only one prize will be awarded. This prize cannot be transferred, redeemed for cash or substituted by winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize is unavailable. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Prize will only be awarded and/or delivered to addresses within USA. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with the Official Rules will result in forfeiture of the prize.
Privacy: All entrants acknowledge that if they are chosen as a winner, certain of their personally identifying information may be disclosed to third parties as required by law, including on a winner’s list. All personal information submitted as part of the Contest is subject to PDP’s privacy policy posted at http://www.pdp.com/en/privacy-policy/.
Limitation of Liability: To the extent allowed by law, by entering you agree to release and hold harmless PDP, Instagram, and their respective parents, partners, subsidiaries, affiliates, employees and agents from any and all liability or any injury, loss or damage of any kind arising in connection with this Contest or any prize won. PDP reserves the right to cancel, change or suspend this Contest for any reason, including cheating, technology failure, or any other unforeseen or unexpected event that affects the integrity of this Contest. If the integrity of the Contest cannot be restored, we may select winners from among all eligible entries received before we had to cancel, change or suspend the Contest. This Contest will be governed by the laws of the State of California, and you consent to the exclusive jurisdiction and venue of the courts in the County of San Diego, California for any disputes arising out of this Contest.
Released Entities: By participating, entrants and winners agree to release and hold harmless PDP, Instagram, Inc. and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Entities”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, or participation in Contest, or possession, acceptance and/or use or misuse of prize or participation in any Contest-related activity and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action. In no event will the Released Entities be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of entrant’s access to and use of any websites associated with this Contest and/or downloading from and/or printing material downloaded from any websites.
Winner’s List: Send an email to promotions@pdp.com with the subject line “PDP Contest winners” within 30 days of the end of the Entry Period to receive a list of winners that received a prize worth $25.00 or more.
